A Contract of Training is a legally binding contract between the apprentice / trainee and the employer. The contract is the basis of a work-based training arrangement to enable the opportunity for people to develop job skills and gain a nationally recognised qualification. Under the contract system the apprentice / trainee agrees to undertake the necessary training to acheive competence in their chosen field and the employer agrees to arrange for training. The contract is registered with Traineeship and Apprenticeship Services (TAS). TAS is a unit of the Traineeship and Apprenticeship Services Directorate of the Department of Further Education, Employment, Science and Technology. TAS manages and administers the Contract of Training system under delegation from the Training and Skills Commission.
After the probationary period of your apprenticeship / traineeship has expired, cancellation of the Contract of Training can only be done by mutual consent between both parties (both the employer and the employee). Approval to cancel the Contract of Training will be granted by TAS upon receipt of a signed request for mutual cancellation. Where both parties do not agree to the cancellation of the Contract of Training the matter is in dispute and is referred to the Grievances and and Disputes Mediation Committee. The Committee will make a determination on the matter.
The failure of an Apprentice / Trainee to meet these obligations may result in a dispute instigated by the employer or subsequent Contracts of Training not being approved.
For more information on the Contract of Training System you can contact Traineeship and Apprenticeship Services (TAS) on 1800 673 097.
